Spilman Client Wins ADA Lawsuit

A Spilman client recently won a victory in a former employee’s Americans with Disability (ADA) lawsuit when the United States Court of Appeals for the Sixth Circuit upheld the prior summary judgment order dismissing the case. The former employee, who has Tourette syndrome, alleged that Spilman’s client illegally forced him to quit based on his disability. However, the Court found that he was lawfully transferred to a different position after customers complained about the offensive language he involuntarily uttered.
