Spilman Member Gerald Titus Appointed to Supreme Court of Appeals of West Virginia

November 24, 2025

Charleston, W.Va. — Spilman Thomas & Battle (Spilman) announced that partner Gerald M. Titus III has been appointed by Governor Patrick Morrisey to serve on the Supreme Court of Appeals of West Virginia. He will fill the vacancy created by the tragic passing of Justice Tim Armstead.

“I am deeply honored that Governor Morrisey has entrusted me with this vital responsibility,” Titus said. “The Supreme Court plays an essential role in safeguarding the rule of law and upholding the rights of West Virginians. I look forward to serving with integrity and unwavering respect for our state’s judicial institutions.”

He continued, “The significance of this appointment is profound. It is a privilege to have the opportunity to contribute to the fair and impartial administration of justice in our state.”

Titus was one of four finalists recommended to Governor Morrisey by the Judicial Vacancy Advisory Commission. Twelve judges and attorneys originally applied for the position. His selection from this distinguished group underscores not only his personal qualifications but also reflects the exceptional quality of legal professionals within Spilman – attorneys known for their intellect, ethical conduct, and steadfast work ethic.

Michael J. Basile, Spilman’s Managing Member, added, “Governor Morrisey could not have selected a more capable or principled individual. Gerald has been an indispensable member of our firm for many years. His legal acumen, judgment, and character make him exceptionally well-suited for this role, and we are immensely proud to see him reach this milestone in his career.”

During his tenure at Spilman, Titus maintained a broad-based legal practice advising clients on corporate litigation, business matters, strategic acquisitions, risk mitigation, environmental and regulatory matters, commercial trucking litigation, federal criminal defense, and alternative dispute resolution. Throughout the course of his career, he has proven himself particularly adept at building consensus to resolve challenging disputes, whether during business negotiations or litigation dispute resolution.
