Ms. Finkenbinder’s primary area of practice is intellectual property, with special emphasis in trademark and copyright law, including clearance, registration, licensing and protection against infringement and advertising law.

  • Advocating for clients’ trademark rights at the United States Patent and Trademark Office, including in cancellation and opposition proceedings before the Trademark Trial and Appeal Board
  • Advising clients on Federal Trade Commission (FTC) and Food and Drug Administration (FDA) regulations
  • Counseling companies on labeling, endorsements and testimonials, comparative and false advertising and claim substantiation
  • Representing clients in advertising matters before the National Advertising Division of the Better Business Bureau (BBB)
  • Providing intellectual property and marketing guidance to clients in a variety of industries, including hospitality, entertainment and resorts, consumer and industrial goods and services, technology, and education, with particular experience in the food industry, advising food manufacturers, growers, processors and distributors
  • Advocating for clients’ interests in domain name dispute proceedings before the National Arbitration Forum
  • Counseling clients on franchising their business models; franchise development and expansion, including the preparation of franchise and area development agreements and franchise disclosure documents; and other franchise issues such as franchise termination and compliance with state and federal laws
  • Providing in-house support to domestic and international companies, assisting with management of trademark portfolios, rebranding, trademark and copyright protection and enforcement, reviewing and approving marketing materials, and offering guidance in other areas of intellectual property and marketing
  • Marketing and legal training provides a unique perspective when developing and implementing marketing and branding strategies, preparing and negotiating agreements, and counseling on advertising campaigns and promotions, eCommerce, social media, sweepstakes, and website issues
