Ms. Weingart’s primary areas of practice are federal black lung, workers' compensation and general litigation.

Experience

  • Defending employers in workers’ compensation claims related to occupational disease, occupational pneumoconiosis, hearing loss and injury
  • Representing employers in appellate proceedings before the Office of Judges, Workers’ Compensation Board of Review and the West Virginia Supreme Court of Appeals, including oral arguments before the Supreme Court
  • Defending employers at all levels of litigation related to Federal Black Lung claims
  • Providing advice and training to third-party administrators, insurance companies and self-insured employers regarding West Virginia workers’ compensation law, claims administration and litigation
  • Coordinating defense of mass filings of workers’ compensation occupational disease claims related to asbestos exposure filed with the Ohio Industrial Commission
  • Drafting legislation for workers’ compensation reform before the West Virginia Legislature in 2003
  • Defending class action product liability and toxic tort lawsuits
  • Serving as defense liaison counsel in asbestos litigation in both a national counsel and local counsel capacity
  • Taught legal communications, written and oral advocacy, at The University of Akron School of Law
