Mr. Simon’s primary area of practice is civil litigation, with particular emphasis on business and commercial litigation and asbestos litigation.

  • Defending regional and national clients in asbestos litigation involving products liability, premises liability, contractor liability, and deliberate intent claims
  • Representing clients in commercial litigation including breach of contract, fraud, construction, eminent domain, and constitutional law disputes
  • Defending clients in insurance and bad faith litigation, and deliberate intent, premises, and products liability lawsuits
  • Participating on a defense trial team in a federal criminal trial in the Southern District of West Virginia
  • Assisting in all phases of state and federal litigation, including drafting pleadings, drafting dispositive and evidentiary motions, conducting written discovery, taking and defending depositions, arguing pre-trial and dispositive motions, participating in trial preparation, voir dire, and jury selection, and drafting multiple appellate briefs to the West Virginia Supreme Court and the Fourth Circuit Court of Appeals
