Insurance Industry Law

For clients operating in the insurance industry, Spilman Thomas & Battle offers the following services:

Insurance Coverage & Bad Faith

Most of the cases in which our firm directly represents insurers are either coverage disputes or bad faith lawsuits. These types of cases pose a substantial risk to insurers in West Virginia. Due to the existence of a private cause of action against insurers under the West Virginia Unfair Trade Practices Act, insurers face a unique challenge when litigating bad faith claims in our state.

Insurance Defense

The firm’s clientele includes large and small employers and businesses, manufacturers, distributors, contractors, professional firms, and individuals. Successfully defending cases requires knowledge of, and experience with, our state and federal court systems, judicial officers, and jury pools.

Insurance Government Relations/ Regulatory

Our work has included representation before the West Virginia Legislature and before various agencies of state government, including the Office of the West Virginia Insurance Commissioner, the Governor’s Office, the Department of Health and Human Resources, and the Division of Motor Vehicles. Reputation, experience, contacts and access are our keys to success. The firm maintains strong and long-standing personal contacts within the West Virginia Legislature and the Office of the Insurance Commissioner.
