Spilman Negotiates Settlement of Complex Deliberate Intent & Workers' Comp Matters
Spilman negotiated a global settlement of a deliberate intent personal injury action and a concurrent workers' compensation case at a pretrial conference. The plaintiff, a 45-year-old underground coal miner, suffered serious injuries during the course of his employment, including incomplete quadriplegia. The litigation team was able to settle the personal injury case for significantly less than the plaintiff's initial settlement demand. With respect to the workers' compensation case, the plaintiff accepted the first offer made to him at the conference. Spilman attorneys worked collectively with the insurer, third-party administrator, and co-defendants to navigate a series of complex issues en route to reaching the final settlement.
