Coal Associations' Emergency Regulation Win is a Win for the Industry

Spilman was retained to file an Amicus for three coal industry associations opposing a Writ of Mandamus by the UMWA and USWA that attempted to force MSHA to enact emergency regulations for COVID-19 in mines. The Spilman team researched, drafted and filed our brief in less than one week. We prepared the brief and affidavits from the director of each association that summarized the steps coal companies have taken to prevent the spread of COVID-19 that made a regulation unnecessary. The DC Circuit denied the Petition, finding MSHA correctly determined an emergency regulation was not necessary and granted the filing of our Amicus. Not only is this a win for our clients, but it is also a win for the coal industry.
