Mr. Titus’ primary practice areas include civil litigation defense, commercial vehicle accidents, product liability and pharmaceutical defense, business litigation, federal criminal defense, State Attorney General investigations and defending against consumer claims. Mr. Titus is passionate about creating value for clients through early case assessment and efficient dispute resolution, whenever possible.

  • Representing clients in commercial vehicle accident defense, including defending claims against trucking companies, motor carriers, coal-haulers, businesses, taxi cabs and other passenger carriers for personal injury, wrongful death, catastrophic injury, property damage and indemnity
  • Defending clients in product liability claims, including defending claims against manufacturers and sellers of pharmaceuticals, medical devices, wheelchairs, pain pumps, knee and hip implants, oxygen delivery systems, consumer products, firearms, automobile components, building materials, manufacturing equipment, workplace personal protective equipment, coal mining equipment and respiratory protection
  • Representing clients in business litigation, including breach of contract, tortious interference, express and implied indemnity claims, mechanics' liens, partition suits, declaratory judgments, complex financial disputes, commission claims and commercial arbitration; experienced handling cases in the West Virginia Business Court Division
  • Defending against professional negligence claims, including defending individual and class action claims for alleged professional negligence relating to engineering and construction projects, natural gas transportation and gathering systems in the Marcellus Shale formation, and the installation of fiber optic cable transmission lines
  • Representing clients in consumer protection claim defense, including defending financial institutions, creditors and collection agencies in class action and individual lawsuits for alleged violations of federal and state consumer credit and protection law, and representing clients in investigations by the West Virginia Attorney General regarding alleged violations of consumer protection laws
  • Providing criminal defense, including against criminal charges and Grand Jury investigations, including alleged mail and wire fraud, money-laundering, White Collar crimes, firearms offenses and illegal drug trafficking, with an emphasis on federal criminal practice
  • Coordinating high-stakes and large-scale litigation with in-house and national counsel
  • Assistant United States Attorney for the Southern District of West Virginia, Violent Crime Division, 2007 - 2009: prosecuted federal offenses, including illegal firearms and serial bank robbery; worked with FBI, ATF, IRS, DEA and state and local law enforcement
  • Judicially-appointed to United States Criminal Justice Act Panel, SDWV, 2014 - present: defending clients against federal criminal charges; current Charleston Division Liaison
