Ms. Herdman's primary practice is litigation, including insurance coverage, insurance bad faith, agency, bankruptcy, distressed loans, negligence, medical malpractice, products liability, discrimination, inmates' rights and class actions. Ms. Herdman has also advised and assisted in the formation of partnerships and limited liability companies and has experience in licensure issues for medical professionals.

Creditors' Rights / Bankruptcy Law

  • Advising clients regarding bankruptcy and distressed loans
  • Negotiating workout agreements between institutional financial clients and commercial borrowers
  • Representing institutional financial clients as both secured and unsecured creditors in individual and commercial Chapter 11 cases
  • Representing institutional financial clients as both secured and unsecured creditors in Chapter 12 cases
  • Representing institutional financial clients in various stages of collection, including relief from stay proceedings, state and federal court deficiency actions, foreclosures and repossession and sale of personal property

Insurance Coverage and Bad Faith

  • Representing insurance companies before various Circuit Courts and District Courts in West Virginia
  • Advising insurance companies regarding claims handling, insurance coverage, bad faith litigation, agency issues, and bodily injury and property damage litigation
  • Advising insurance agents regarding negligence and bad faith litigation
  • Assisting in the defense of insurance companies in insurance coverage and bad faith litigation
  • Assisting insurance agents in negligence and bad faith litigation
  • Preparing and arguing cases before the United States District Court for the Southern District of West Virginia and the United States District Court for the Northern District of West Virginia

  • Represented clients in matters involving breach of contract
  • Advised and assisted medical professionals regarding licensure issues and representation of medical professionals before the State Medical Board of West Virginia
