Spilman 's construction law practice is a natural extension of our practice in real estate, economic development, labor and employment, workers' compensation, product liability, corporate law and litigation. Our construction law practice complements our representation of clients on the issues inevitably encountered during the life of any business.

The group's initial goal is to assist clients in avoiding problems in construction projects. The firm provides advice and analysis on payment schedules, project completion and warranty and indemnification provisions. We understand the need to maintain a good working relationship while negotiating reasonable contract terms. Our corporate attorneys are also experienced and knowledgeable in drafting and reviewing contracts and bonds, and explaining their terms to clients. Armed with this information, future problems can be minimized or avoided altogether.

Unfortunately, in today's litigious society, many construction projects, including new construction, remodeling or additions, result in lawsuits or the threat of lawsuits. We assist clients as early as possible in these disputes to achieve prompt and fair resolutions. The diverse experience of our attorneys and our many practice groups enables the firm to intervene early and in a variety of ways. This same diversity allows us to represent owners, general contractors, subcontractors, suppliers, architects, designers and others involved in all types of commercial, residential or public construction.

The firm's experience in construction litigation includes disputes involving:

Whether our clients are involved in disputes regarding payment, performance, or delay, the firm can assist in the negotiation, mediation, arbitration or litigation of claims. As in our other areas of practice, we will work with clients to avoid potential disputes. Should a dispute arise, however, a thorough early case assessment can be instrumental in achieving a resolution without litigation. The firm's experience can be of great benefit should litigation become necessary.
