Mr. Battle's primary areas of practice are workers' compensation, employment relations and counseling, product liability litigation, and commercial litigation.
Representative Experience
- Defense of employers in workers' compensation claims related to workplace injuries, occupational disease, occupational pneumoconiosis and hearing loss
- Advise employers on leave policies and other employment-related matters
- Defense of employer deliberate intent, toxic tort and product liability matters in state and federal courts
- Defense of employment discrimination claims in federal and state courts, including age, gender, race and disability discrimination, and harassment cases
- Defense and trial of administrative claims before the West Virginia Human Rights Commission
- Negotiate successful mediation of wrongful employment discharge, employment contract disputes and premises liability cases
- Trial experience in corporate premises liability defense, medical malpractice defense matters and employment discrimination matters
- Represent financial institutions and loan servicing companies in federal and state courts regarding federal and state banking laws, consumer credit and protection, TILA, and Regulation Z
