Ms. Weingart’s primary areas of practice are workers’ compensation, federal black lung and general litigation.

Representative Experience

  • Defense of employers in workers’ compensation claims related to occupational disease, occupational pneumoconiosis, hearing loss and injury
  • Representation of employers in appellate proceedings before the Workers’ Compensation Board of Review and the West Virginia Supreme Court of Appeals
  • Defense of employers at all levels of litigation related to Federal Black Lung claims
  • Provide advice and training to third-party administrators, insurance companies and self-insured employers regarding West Virginia workers’ compensation law, claims administration and litigation
  • Coordination of defense of mass filings of workers’ compensation occupational disease claims related to asbestos exposure filed with the Ohio Industrial Commission
  • Drafted legislation for workers’ compensation reform before the West Virginia Legislature in 2003
  • Defense of class action product liability and toxic tort lawsuits
  • Served as defense liaison counsel in asbestos litigation in both a national counsel and local counsel capacity
  • Taught legal communications, written and oral advocacy, at The University of Akron School of Law
