Mr. James' primary area of practice is intellectual property, including patent, trademark and copyright prosecution, litigation, negotiations, opinions, due diligence, and licensing.

Representative Experience

  • Drafting, prosecuting and enforcing patents in a series of suits in the Federal District Court for the Western District of Pennsylvania resulting in large dollar and percent royalty licenses
  • Defeating claim of patent infringement in the Federal District Court for the Southern District of Texas on summary judgment and winning damages for patent false marking claim against plaintiff at trial
  • Achieving trademark registration over opposition filed with the Trademark Trial and Appeal Board by a much larger and older entity
  • Prosecuting intellectual property for a medical device start-up and its successor and driving sales of both those companies based on that intellectual property
  • Assisting clients in designing around patents for major, successful product releases; preparing non-infringement opinions for many of those products, none of which have been opposed
  • Drafting and prosecuting United States and foreign patent applications in a wide range of technologies, including automated systems, computer systems, electronic and mechanical devices, and medical devices and procedures
  • Overcoming rejections in a variety of difficult trademark applications

Other Professional Experience

  • Former Vice President of Operations, Voltec, Inc.: Responsible for production of critical laboratory automation products, project management, application  engineering, and field operations
  • Former Principal Engineer, Honeywell, Inc.:  Designed systems for more than 100 automation projects including the automation of all facilities at Pittsburgh International Airport, a site with a single integrated system of more than 20,000 points.  Received a dozen Honeywell awards including national recognition with his group’s highest technical honor
