Mr. Scott's primary areas of practice are commercial and business litigation, construction law and litigation, creditors' rights, insurance coverage and bad faith, and intellectual property litigation.

Representative Experience

• Defended highway contractor in patent infringement action related to accused slab leveling and soil stabilization methods
• Represented national new home warranty company in arbitration proceedings related to structural warranty claim for alleged defects in monolithic slab foundation system
• Represent and advise multiple community banks in connection with landlord-tenant issues following foreclosure of commercial and residential real properties
• Represent specialty subcontractor in asserting cost overrun claims related to high-profile emergency highway rockslide stabilization project
• Represent and advise multiple community and super regional banks in litigation and collection actions stemming from distressed commercial loans
• Defended international manufacturer as project owner in cost overrun claims by contractor related to industrial piping installation
• Served as local counsel to leading research university and pharmaceutical manufacturer in Hatch-Waxman patent infringement litigation
• Represented multiple construction industry clients in filing and enforcing mechanic's liens arising from a variety of projects
• Represented general contractor in cost overrun and delay claims against municipality, and product liability claims against piping manufacturer, related to nine-mile force main sewer installation project
• Represented major industrial manufacturer in ground lease litigation involving environmental contamination
• Represented insurers and insureds in complex insurance coverage and bad faith litigation arising from commercial general liability, errors and omissions, automobile, and workers' compensation policies
• Serve as lead and local counsel in business litigation involving all aspects of contract and commercial disputes
• Represented two private security licensees in disciplinary proceedings before the North Carolina Private Protective Services Board
• Represented insurance broker in disciplinary proceedings before the North Carolina Commissioner of Insurance
• Experience in federal and state appellate matters, jury and bench trials, and administrative hearings
