Representative Experience
- Defending clients in litigation brought under numerous federal and state consumer protection laws, including the Fair Debt Collection Practices Act, Telephone Consumer Protection Act, and the West Virginia Consumer Credit and Protection Act
- Counseling clients on compliance with federal and state statutes, including the Fair Credit Reporting Act, and the Truth in Lending Act
- Defending financial institutions and creditors in class action and individual lawsuits for alleged violations of state and federal consumer protection laws
- Representing clients in investigations by the State Attorney General regarding alleged violations of consumer protection laws
- Representing creditors in bankruptcy matters, including asset purchase, relief from stay, preference, claim objection, and other bankruptcy litigation, as well as in the confirmation process
- Representation of financial institution and other creditors in collection litigation
- Counseling financial institution and other creditors regarding deficiencies in loan documentation that may be exploited by bankruptcy trustees or other lien holders
- Past experience representing individuals in diverse areas of litigation, including land disputes, will contests, divorce, child custody, child support, domestic violence, and other general litigation matters
