Mr. James' primary area of practice is intellectual property, including patent, trademark and copyright prosecution, litigation, negotiations, opinions, due diligence, and licensing.

Representative Experience

  • Enforced patents he drafted and prosecuted in a series of suits in the Federal District Court for the Western District of Pennsylvania resulting in large dollar and percent royalty licenses
  • Defeated claim of patent infringement in the Federal District Court for the Southern District of Texas on summary judgment and went on to win damages for patent false marking claim against plaintiff at trial.
  • Achieved trademark registration over opposition filed with the Trademark Trial and Appeal Board by a much larger and older entity
  • Prosecuted intellectual property for a high tech start-up and its successor and drove sales of both those companies based on that intellectual property
  • Assisted clients in designing around patents for major, successful product releases; prepared non-infringement opinions for many of those products, none of which have been opposed
  • Drafted and prosecuted United States and foreign patent applications in a wide range of technologies, including automated systems, computer systems, electronic devices and mechanical devices
  • Overcame rejections in a variety of difficult trademark applications
